Terms & Conditions
SESSIONS FEES
The session fee covers the photographers time and talent only, does not include any images (unless it states otherwise) and is due at time of booking. Session fees taken for any portrait photography session are non-refundable except in the event Adele Morris (photographer) cancels the booking. The Client may cancel a session at any time but in doing so shall forfeit any monies paid. If you or your children are sick, please give 48 hours’ notice to reschedule your session. If 48 hours’ notice is not given or client is a no show, there will be a rebooking fee charged, which is a minimum of £75 for up to an hour. Lateness to any session risks cancellation, there is 15 minute discretion from the time the session is scheduled to start, if the session is agreed to continue, the timings of the session will not change and cause the session to be shorter. Sessions that overrun through no fault of Adele Morris Photography will be charged an additional £85 fee per hour.
Event style Photoshoot is payable on an hourly rate, the first hour is charged at £200 and consecutive hours are charged at £100, a minimum of 2 hours is required for an event booking which must be paid upfront to secure the time and date.
PRICE OF PRODUCTS
Session fees do not include any images or products. Upon booking a session please make sure you have fully viewed the price list. It is presumed every Client has read the price list. As a guide clients generally spend £500+.
FULFILMENT OF OBLIGATIONS
There is no guarantee that any particular number of proofs will be produced. Proofs will be available for your in-studio view and order session within 4 to 8 weeks. All orders are due at this time. As creative artist, Adele Morris Photography will aim to select 10 - 15 images for your slideshow presentation, unless package booked includes a set number or more than 15 images.. Adele Morris Photography is not obligated to provide the client with any images that are not already presented to them. Client is responsible for attending a view and order session within 2 weeks of the images being ready for viewing. For all orders, payment is due in full at time of order. All portrait orders are final and cannot be changed or refunded for any reason.
PROOFS/VIEW AND ORDER SESSION
Images are fully edited before presenting to Client. Additional edits are carried out at the discretion of Adele Morris Photography. Adele Morris Photography reserves the right to charge the Client for additional editing to cover time involved. Only one complimentary viewing session is offered per client session. Additional viewing sessions to complete the order will be charged at a minimum of £85 or up to an hour scheduled session. And any changes to orders will incur a minimum of an additional £45 admin charge to the final invoice. Session fees apply to order session, for example lateness, cancellation, etc, see session fees above for breakdown.
ARTISTIC INPUT
Adele Morris Photography shall not be liable to the Client for any failure, in whole or in part, to fulfil their obligations where failure arises as a result of an event or circumstances beyond her control, which may include (but are not limited to) equipment failure, inclement weather, illness or injury. The Client understands and accepts that the photographic coverage will be as Adele Morrs’ professional expertise determines. Special requests are not binding instructions although every effort is made to comply with the Client’s wishes. Any further editing requests need to be confirmed during the viewing session or within 10 days after the gallery/photo is delivered to the client. These additional edits will be subject to an editing fee at the photographer's discretion. Any editing requests which fall outside of the 10 days will incur an additional £85 fee per gallery which reinstates a further 10-day process from contact to compete, anything processed outside of this window which is outside of Adele Morris Phoptography's control will also incur a minimum additional admin charge of £25 per gallery to the final invoice.
In the unlikely event of total photographic failure or cancellation of the , contract by Adele Morris Photography liability shall be limited to a full refund of all monies paid.
COPYRIGHT & REPRODUCTION
Copyright is retained by Adele Morris Photography at all times throughout the world. No image can be copied, scanned or reproduced in any form whatsoever without the prior consent of Adele Morris Photography. The Client may not alter or add to or manipulate a picture by any means or reproduce a picture in whole or in part as an element within, or as a montage with, another picture without Adele Morris Photography written permission. Permission to reproduce a picture for personal use (not commercial) is granted to the Client by Adele Morris only when digital negatives are purchased and paid in full by the Client to Adele Morris.
USE OF PICTURES
Adele Morris Photography retains the right in all cases to use any pictures for the purposes of displays, advertising, portfolio, publication or promotion, of her work.
FAILURE TO DELIVER PRODUCTS AND PRINTS
Adele Morris Photography shall not be held liable for delays in the delivery of such Work Product, or any Work Product undeliverable, due to technological malfunctions, service interruptions that are beyond the control of Photographer (including as a result of delays in receipt of instructions from Client), and for Work Product that fails to meet the specifications set due to the actions of Client or attendees or participants at the photo shoot that are beyond the control of Photographer (e.g., camera flashes, clients not cooperating).
RECEIPT OF PORTRAITS, WALL ART OR PRODUCTS
All orders are presumed to have been received in good condition unless the Client notifies Adele Morris Photography in writing of any discrepancy or error within 14 days of receipt.
COOLING OFF PERIOD
All portraits, digitals, books, albums, frames, etc. are non-refundable. Orders cannot be canceled due to the custom nature of the products. Orders are made to the Client’s personal specification, (i.e. digital, image number, print size, frame style, etc.), the Client does not have the right to a cooling-off period. By placing an order with Adele Morris Photography you are committing to buy the ordered products.
COMPLEMENTARY PRODUCTS, CREDIT NOTES, VOUCHERS AND GIFT CARDS
Adele Morris Photography does not accept any responsibility or liability for lost, damaged, stolen or any unauthorized use of complementary gifts and products, credit notes, vouchers and gift cards. The monetary value of complementary gifts and products, credit notes, vouchers and gift cards is not transferable under any circumstances. A £30 admin charge is required to be amended to replace lost or stolen credit notes, vouchers and gift cards, and to extend the expiry date by an additional 3 months, when still in date. The choice of complementary gifts and products is at the discretion of Adele Morris Photography and can not be exchanged or refunded under any circumstance, including if lost, stolen or damaged.
RETURNS POLICY
Incorrectly supplied items and items of poor quality can be returned and will be replaced at no extra charge to the Client. Returns will not be considered for incorrectly ordered items or items ordered in error.
DELETED IMAGES
All non-purchased images are deleted 3 weeks after your view and order session or 2 months after the photography session, whichever is sooner.
WAIVER
Cameras, mobile phone cameras, and camcorders are NOT permitted during any session, in the studio, or on location without express permission from Adele Morris Photography. If permission is not granted, Adele Morris Photography will end the session and service due to exploitation of photography work.
CONSISTENCY AND STYLE.
Adele Morris Photography shall be entitled to use her judgment regarding the style and artistic input in the production of pictures. This includes but is not limited to poses, props, and the number of images taken. Due to the willingness of subjects, it may not be possible to capture all the pictures requested or images to the client’s full expectations. In the event of uncooperative children at a session of any kind, for any reason, Adele Morris Photography may not be able to capture any, or all the images the Client may have requested or expected. Photographer does not take responsibility for desired images not being achieved if clients being photographed are uncooperative. The Client is responsible for all children at all sessions. When booking you need to bare in mind sessions can over run and due to this you take full responsibility for preparation of the wait before we invite you in to begin your session.
CANCELLATIONS
Adele Morris (Photographer) shall not be liable to the Client for any failure, in whole or in part, to fulfill her obligations where the failure arises as a result of an event or circumstances beyond her control, which may include (but are not limited to) equipment failure, inclement weather, illness or injury. In the unlikely event of total photographic failure or cancellation of the contract by Adele Morris liability shall be limited to a full refund of all monies paid.
GIFT VOUCHERS
Gift vouchers are valid for 12 months from date of issue. Unused values will not be refunded or attributed to any transactions after the expiry date. Gift vouchers can be redeemed against Portrait, newborn and maternity sessions at Adele Morris Photography. Gift vouchers are exempt from being used to purchase seasonal mini sessions, products and prints, unless specified.
Gift vouchers cannot be redeemed for cash, returned for a refund, have their balances consolidated to a new voucher or be replaced after expiry and are not legal tender, account cards, credit or debit cards or securities.
If your purchase exceeds the value of the gift voucher, balance must be paid by cash, debit or credit card. If you return any products you have purchased using a gift voucher, the balance will be credited to you as a credit note and is to be redeemed against subsequent purchases.
Gift vouchers cannot be replaced if lost or stolen. If you suspect an unauthorised activity, immediately report this to Adele Morris Photography. Adele Morris Photography reserves the right to cancel a gift voucher if we deem such action necessary. If so, we may either provide a replacement gift voucher of equivalent value unless we suspect fraud in relation to a gift voucher. The gift voucher remains our property.
When booking a session using a Gift vouchers, the balance of the smallest session package must be paid in full and the voucher can be used towards this. Unless stated ootherwise, gift vouchers are not valid or can be redeemed towards mini or seasonal sessions.
Adele Morris Photography can vary or replace these conditions from time to time (including to introduce new fees)
